 VA proposes updating the Disability Rating Schedules for Respiratory


VA published a press release today proposing changes to the VA Schedule for Rating Disabilities. The proposed changes specifically relate to the auditory, mental and respiratory systems. The proposed changes would include modern medical knowledge and medical advances to help Veterans with certain disabilities.


VASRD is used by the VA to determine the level of compensation needed for each service-related disability. This compensation is determined based upon the severity of the condition and any supporting medical evidence. VA is currently updating the VASRD's body systems to reflect current evaluative standards based upon medical terminology, diagnostics, and treatment.


The Veterans Benefits Administration (VBA) will publish proposals in the Federal Register on February 15 regarding proposed changes to regulations for the following two body systems: the respiratory system; the ear, nose and throat condition; and auditory disorders. The proposed rules will be open for comment for 60 days by Veterans and the general public.


These are proposed changes and will not have any effect on the evaluations for Veterans currently receiving compensation due to an impacted disability. The public and Veterans have 60 days to comment on the proposed changes. VA will take into consideration the comments and address them in a future final rule that may make these changes more effective.


Modernizing the evaluation criteria of sleep apnea is one of the changes proposed. It will be based on how responsive the symptoms are to treatment. Veterans who have had their symptoms treated with CPAP machines or other treatments will be rated at 0%. They would not receive compensation. VA will give progressively higher percentage evaluations based on how symptomatic they are after treatment. This will align the rating criteria of sleep apnea closer to the stated purpose, which was to provide evaluations based on the average impairment in earning capacity.


Proposed rules would reduce the requirement for a 100% rating for respiratory diseases such as asthma and chronic-obstructive pneumonia disease (COPD) by slightly lowering the requirements. Tinnitus is one of the conditions that the proposed rules would allow. The Veteran could be compensated for it through service-connected compensation.


The minimum disability rating for mental health conditions will be increased from 0% to 10% by the proposed rules. The VASRD dated section that prevented a Veteran from receiving a 100% rating due to a mental illness condition would be eliminated by the rule.


VA will make sure Veterans receive the proper compensation, especially for mental disorders. VA will use new evaluation criteria under the proposed changes to better capture the various domains of mental disability and provide greater compensation for Veterans with service-related mental disorders. Fearsome Roulette Lady - Bring On The mentions of Fraud!
